Welcome to RecruiteAI, an AI-powered video interviewing and candidate assessment platform owned and operated by Bitsoft International, Inc. (“Bitsoft,” “RecruiteAI,” “we,” “us,” or “our”). RecruiteAI enables employers to conduct structured video interviews and receive AI-assisted insights to support recruitment and hiring processes.

These Terms and Conditions (“Terms”) govern access to and use of the RecruiteAI employer management platform (“Service” or “Platform”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Use of the Service

You may use the Service only in accordance with these Terms and all applicable laws and regulations. You must be at least 18 years old to register for and use the Service.

2. Account Registration

  • You must provide accurate, complete, and current information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are solely responsible for all activities conducted under your account.

  • We may suspend or terminate your account if unauthorized use or security breaches are suspected.

3. Subscriptions & Payments

  • The Service may include free trials, paid subscriptions, and custom enterprise plans.

  • Pricing, billing cycles, and access limits are described on our pricing page or in applicable agreements.

  • Payments are processed via third-party providers such as Stripe or Chargebee.

  • You authorize us to charge applicable fees and agree to maintain valid payment information.

4. Cancellation & Refunds

  • Subscriptions may be canceled at any time.

  • Refunds are not provided for partial billing periods unless required by law.

  • We reserve the right to modify pricing or plans with reasonable prior notice.

5. AI and Interview Features

  • The Platform uses artificial intelligence to analyze interview responses, generate follow-up questions, and provide behavioral and communication insights.

  • AI-generated insights are informational and assistive only.

  • AI outputs must not be used as the sole basis for hiring or employment decisions.

  • You acknowledge that AI results may contain limitations, bias, or inaccuracies and require human review and judgment.

6. Candidate Data & Recordings

  • Interview videos, audio, transcripts, analytics, and related data are stored securely and accessible only to authorized users.

  • You act as the Data Controller for candidate personal data.

  • You are solely responsible for:

    • Providing lawful notice to candidates

    • Obtaining all required consents, including explicit biometric consent where applicable (e.g., Illinois BIPA)

  • RecruiteAI acts as a Data Processor on your behalf.

  • Candidate data may be deleted via your dashboard, subject to retention obligations under law and backup policies.

7. Data Protection & Privacy

  • RecruiteAI complies with applicable data protection laws including GDPR, CPRA/CCPA, and other privacy regulations as described in our Privacy Policy.

  • Use of the Service is subject to the RecruiteAI Data Processing Agreement (DPA), which is incorporated by reference.

  • You agree to comply with all applicable privacy and employment laws when using the Service.

  • While we implement appropriate technical and organizational security measures, absolute security cannot be guaranteed.

8. Acceptable Use

You agree not to:

  • Use the Platform for unlawful, discriminatory, or unethical purposes

  • Upload malware, harmful code, or malicious content

  • Reverse-engineer or improperly access the Platform

  • Interfere with Platform operations or other users

Violations may result in suspension, termination, or legal action.

9. Intellectual Property

  • All software, code, content, trademarks, and branding are the exclusive property of Bitsoft or its licensors.

  • You are granted a limited, non-exclusive, non-transferable license to use the Service during your active subscription.

10. Third-Party Services

The Platform may integrate with third-party services (e.g., Azure, OpenAI, Cloudflare, Salesforce, WordPress, AWS, etc.). We are not responsible for the availability, performance, or content of third-party services.

11. Termination

We may suspend or terminate your access:

  • For violations of these Terms

  • For non-payment

  • Where your use creates legal, regulatory, or security risk

Upon termination, access to the Platform will cease and data may be deleted in accordance with the DPA and Privacy Policy.

12. Disclaimers

The Service is provided “as-is” and “as available.”
We make no warranties regarding uninterrupted operation, accuracy of AI outputs, or suitability for specific hiring decisions.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

  • We are not liable for indirect, incidental, or consequential damages.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles.

15. Modifications to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or Platform notice.
