This Privacy Policy applies to employers using the RecruiteAI management platform and to candidates participating in interviews hosted on the platform.

1. Roles Under Data Protection Law

  • Employers using RecruiteAI act as Data Controllers for candidate personal data.

  • RecruiteAI acts as a Data Processor processing candidate data strictly on the employer’s documented instructions.

  • RecruiteAI may act as an independent Data Controller for limited operational data such as platform security, billing, fraud prevention, and service analytics.

2. Information We Collect

A. Personal Information

  • Name

  • Email address

  • Phone number

  • Candidate ID

  • Metadata provided during registration or account use

B. Interview Information

  • Video recordings

  • Audio recordings

  • Interview transcripts

  • Responses to interview questions

  • Timing and interaction metrics

C. Behavioral & Communication Signals

RecruiteAI may analyze, where enabled by the employer:

  • Tone variation

  • Speech clarity and pace

  • Engagement patterns

  • Eye-contact consistency

  • Facial expression categories

  • Communication structure and response patterns

These insights are assistive only and support human review.

D. Technical & Device Information

  • IP address

  • Browser type and version

  • Device operating system

  • Session logs

  • Network and diagnostic data

3. How We Use Information

We process personal data to:

  • Conduct and facilitate video interviews

  • Generate AI-assisted interview analytics

  • Improve interview experience and platform functionality

  • Detect fraud, abuse, and security incidents

  • Comply with legal and regulatory obligations

4. Legal Bases for Processing (GDPR)

Where applicable, processing is based on:

  • Consent (e.g., interview recording, AI analysis)

  • Contractual necessity (providing the Service)

5. Biometric & AI Processing Disclosure

  • Video and voice data may constitute biometric data under certain laws, including the Illinois Biometric Information Privacy Act (BIPA).

  • Automated tools may analyze interview recordings to generate insights.

  • No automated hiring decisions are made by RecruiteAI.

  • All hiring decisions remain under human control by the employer.

6. Data Sharing

Personal data may be shared with:

  • Employers and authorized users

  • Cloud infrastructure providers

  • AI and analytics processors

  • Security and monitoring vendors

  • Legal authorities where required by law

All service providers are contractually obligated to protect personal data.

7. Data Retention

  • Based on employer deletion instructions

  • As required to comply with applicable laws

Biometric data, where applicable, is retained only as long as necessary to fulfill its original purpose.

8. Data Subject Rights

Candidates must submit requests through the employer, acting as Data Controller. RecruiteAI assists employers as required under the Data Processing Agreement.

RecruiteAI uses:

  • Analytics cookies to improve platform performance

Cookie preferences may be managed through browser settings or applicable consent tools.

10. Security Measures

We implement appropriate technical and organizational safeguards, including:

  • Encryption in transit and at rest

  • Access controls and authentication

  • Audit logs

  • Secure cloud infrastructure

While we take reasonable steps to protect data, no system is completely secure.

11. Children’s Privacy

RecruiteAI is not intended for individuals under the age of 18. We do not knowingly collect personal data from minors.
